Rental Agreement

We HIGHLY RECOMMEND travel insurance. Like all insurances know what you are getting, call, ask questions. Use an internet search for companies out there that specialize in travel insurance. Many do not give full refunds only partial and under special circumstances. Life happens and there is a myriad of reasons you may need or choose to cancel so PLEASE take responsibility and protect your investment by insuring against unforeseen events. This is addressed again farther into this agreement.


RESERVATIONS: Reservations are accepted in advance and confirmed rate will be guaranteed. Rates are subject to change without notice unless confirmed with a deposit.

All rentals are subject to a cleaning fee and taxes and listing site fee as applicable.

MINIMUM AGE REQUIREMENT: You must be at least 21 years old to rent. By accepting this

agreement signer testifies that they are at least 21 yrs of age.

MINIMUM STAY REQUIREMENT: For the on line booking feature a 2 night minimum is required. We will rent one night when it is the only open night between other bookings. Owners reserve the right to require minimum stays based on seasons/holidays/calendar availability etc.

METHODS OF PAYMENT: Visa, Mastercard, and Discover, echeck

NON-SUFFICIENT FUNDS AND PAYMENT REVERSALS: Guest is responsible for any and all fees associated with NSF and payment reversals.

CANCELLATIONS: Reservations canceled at least 60 days before the start of the stay will receive a 100% refund (including service fees paid to the listing site). Reservations canceled at least 30 days before the start of the stay will receive a 50% refund. NOTE: Cluff Cabins has no access/control over the service fees charged by the listing site, collected at time of booking (1st payment). For full protection of your trip we recommend trip insurance, see more on this subject below. Note: Reservations must be paid for no later than 30 days prior to arrival. Timely payments are the sole responsibility of the reservation holder and once in overdue status reservation will be considered voluntarily surrendered/cancelled by reservation holder and all monies paid toward the reservation forfeited. Date and other changes to reservations may result in a $25.00 administrative fee.

All changes or cancellations must be received in writing (email will be considered in writing as long as we acknowledge receipt of the email). If proper notice is not given as indicated, the deposit will be forfeited.

REFUNDS: No refunds will be given due to but not limited to the following: weather road/conditions (We recommend four-wheel drive and/or chains in the fall, winter and earlyspring seasons), acts of God, medical emergencies, pandemics, mechanical failures at the rental, govt forced travel restrictions, early departures or for health or other personal reasons No student groups, house parties or receptions are allowed. If guests are found to be having a party, they will be asked to vacate the unit and no refund will be given.

TRIP INSURANCE: Trip insurance is the only way to protect your investment. Trip insurance can be purchased through the online reservation system (but it isn’t great insurance and will not cover your entire trip) or you may purchase a policy through another source ( We strongly recommend that you purchase trip insurance for your peace of mind, especially during the winter months when weather may impede travel. Like any insurance be SURE you know what you are getting, for example if you are concerned about canceling due to weather make sure the policy covers weather cancellations etc. Look for the best coverage for any and all possible reasons to cancel, we suggest the cancel for any reason insurance because life happens.

CHECK IN: Check in time is 4 p.m. (EST) There is no physical location for check in. CHECKOUT: Checkout time is 10 a.m. (EST) and is strictly enforced; late checkouts are not tolerated and may incur a $50 fee deducted from damage deposit.

EQUIPMENT and FURNISHINGS: A phone is available in the cabin for local and long distance calls within the US and Canada.
The cabin has cable TV. Service could get interrupted during bad weather. CD and DVD players

available. Kitchens are equipped with most small appliances. Please use appliances ONLY for their intended use.
A washer and dryer are located in the cabin. An iron and ironing board are provided, please empty water out of irons and return them to the original stored position after use.

WIFI INTERNET SERVICE: Charter Cable provides wifi internet and providers alone are responsible for the speed, reliability and quality of internet service provided which can be affected by weather.

No guarantees or compensation concerning lack of or quality of internet services, compatibility with your internet-enabled equipment or being able to provide technical assistance setting up your devices on the WIFI connection provided.
Internet service provided to our guests are so that they can to do normal web surfing, E commerce, email exchanges and internet messaging. The internet service offered in our cabins is not for illegal activity including but not limited to illegal downloading or sharing of music, movies or software, visiting web sites with content illegal in the state of Tennessee, or high bandwidth use including and not limited to extensive online gaming, commercial use or high volume downloads. You may be billed for any overages that the Internet Service Provider bills the homeowner.

All users of public internet connections should have their own anti-virus and firewall software enabled.

LINENS and SUPPLIES: Bed linens and bath towels are provided along with basic kitchenware and utensils.
A starter supply is provided of personal soap, dish washing detergent, toilet paper, trash bags, and paper towels. Personal items such as shampoo or hair dryers are not supplied so please bring your own.

WATER AND SEPTIC: Treetop Treasure is on city water and is on a septic system. Please do not flush anything down toilets but toilet tissue. Feminine products, baby wipes etc. should not be flushed at anytime. If it is found that such products were flushed and a clog results you may be charged all fees associated with unclogging and resulting damages.

HOT TUBS: Hot tubs are drained, cleaned and refilled after each guest stay. The bromine floater in the tub should provide the proper amount of chemicals to maintain the water quality, but sometimes due to weather conditions or heavy use, the water may become cloudy. Hot tubs should not be used if you are pregnant or have health conditions where extended periods in hot water may not be safe. Children must be supervised at all times and never left unattended in the tub. Jewelry may become discolored from the chemicals. Please shower before using the hot tub if you use tanning oils or any type of lotions because they adversely impact the hot tub chemicals/water quality. Never put additives such as bath salts or bubbles in the hot tub.

OUTDOOR GRILLS: Propane grill and propane are provided for guest use. Guests are expected to read and adhere to all instructions regarding use of grills.


FIREPLACES: Fireplace season is Oct 1 – March 31. Firewood is provided during wood burning season however you will need to bring kindling and newspaper both of which can be purchased at most convenience stores or groceries in the local area.


SMOKING: Smoking is not permitted inside the cabin. Cans for ashes/butts provided on each of the exterior decks.

OCCUPANCY and HOUSEKEEPING: Occupancy limited to persons listed on booking confirmation only. Parking is limited to 2 vehicles.

Hot tub cover must remain on hot tub and latched when not in use. DO NOT STAND OR SIT OR PLACE ITEMS on hot tub cover. If cover is damaged by you, you will be required to pay for replacement. No children under 16 years of age in hot tub without adult supervision.
We require that you place all trash in bear proof containers outside and latch the lid in place, leave the kitchen clean, dirty dishes ran through dishwasher. Lock all windows and doors; turn off lights, TV’s etc. Setting of the thermostat to a reasonable level (season appropriate) when you depart is appreciated.


DAMAGE: In the event of damages or extra cleaning requirements created by guests, additional charges may be applied. Guest is required to put up a refundable damage deposit payable 30 days prior to check in date. Damage deposit refund will be processed within 10 days of Guest check out date as long as no damages occurred during Guest stay. If items are left behind during the stay and you want them returned a fee PLUS postage may be deducted from

the refundable deposit and the remainder processed as a refund.

Owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.

WILDLIFE AND PESTS: The Great Smoky Mountains has more than 1,000 square mile of continuous wilderness including the Great Smoky Mountains National Park, National Forests, state parks and wilderness areas. Though relatively rare, black bear and other wild life can be encountered outside of these wildlife sanctuaries. Wildlife normally will stay away from cabins and chalets unless it has been food conditioned.

For your own safety and the protection of our wildlife, we request that guests behave in an appropriate manner and keep their distance and that you do not feed bear, raccoons or any wildlife. You also need to make sure all food and garbage is secured so that wildlife does not have access to it. DO NOT LEAVE FOOD OR FOOD WRAPPERS IN YOUR CAR, bears have exceptional noses and may cause damage trying to get at the food/wrapper.

There are also plenty of insects. The cabin is treated at regular intervals however it does not eliminate all pests. Certain times of the year we experience high volumes of a beetle which looks like a lady bug they are harmless just a nuisance. Other frequent pests are wood boring bees and wasps.

ACCESS: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
